Well, after yesterdays shocking, 8-1 Supreme Court ruling that police can kick down any door they like if they believe evidence is being destroyed, if you were not a believer of my adage that the Constitution is DEAD maybe now you will be.
The 9, wise men and women on the court basically ended 800 years of English speaking tradition when they ruled that KY police were protected by the 4th amendment to break into to someones home if the cops thought evidence was being destroyed. And in writing their ruling as applicable to all 50 states and every local police force in the land the Supremes can now add killing the state constitutions to their growing list of legal contributions.
Of course my point of view is only valid if you understand the purpose of the Federal Bill of Rights when it was written and ratified in 1791. All that is needed to explain that is the preamble to the fabled, and now crumpled, document THE Conventions of a number of the States having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best insure the beneficent ends of its institution.
Well the Bill of Rights institution as a check on Federal power ended yesterday and its elevation as guarantor of the emerging police state began.
