Mandeville, LA – When the Constitution was ratified in 1788, the qualifications for office were spelled out and immediately became a subject of controversy. In 1794, PA had selected Albert Gallatin as one of its U.S. Senators, when Gallatin arrived to take his seat he was told he could not because he was not a proper citizen of PA or any other of the United States. Even though Gallatin had been in the U.S. since 1780 and had claimed citizenship in VA, MA and then PA, the Senate voted 14-12 that he had not become a citizen properly and was therefore ineligible.

Last week, Senate candidate Rob Maness asked the LA Secretary of State to investigate whether Mary Landrieu was qualified to be a Senator from LA seeing as how she no longer lives here but instead lives in Mordor on the Potomac. Landrieu countered this argument claiming she is an inhabitant because she votes in LA using her parent’s home in New Orleans as an address. Apart from Landrieu touring the state and passing out Katrina and ObamaCare bailout-cash, that is difficult to concede.
LA law requires Senate candidates to be citizens of the U.S. for 9 years, be 30 years old and be “an inhabitant of Louisiana when elected.” The sticky part is what does the term “inhabitant” mean? The Constitution actually says that one must NOT be an inhabitant of a state which in 1788 meant a visiting immigrant with some privileges of citizenship. Webster’s defines “inhabitant” as “one that occupies a particular place regularly” and distinguishes that occupant with the example “the inhabitants of the town don’t like the tourists.” Using that definition, Landrieu certainly acts more like a tourist than an inhabitant with the difference being her trips to frolick in Louisiana are paid for with Other People’s Money while a tourist uses t heir own.
