Among those slapped with a subpoena is Steve Riggle, the senior pastor of Grace Community Church. He was ordered to produce all speeches and sermons related to Mayor Annise Parker, homosexuality and gender identity.

The mega-church pastor was also ordered to hand over “all communications with members of your congregation” regarding the non-discrimination law.

Mike:  Don’t do it, pastor.  Do not hand this over.  You are under no compulsion and there is no law that can be promulgated that can make you.  I have a copy of the Texas Constitution, by the way, in front of me.  We’ll get into that in just a moment.

“This is an attempt to chill pastors from speaking to the cultural issues of the day,” Riggle told me. “The mayor would like to silence our voice. She’s a bully.”

Rev. Dave Welch, executive director of the Texas Pastor Council, also received a subpoena. He said he will not be intimidated by the mayor.

Mike:  Good for you, Dave, you shouldn’t be.  Folks, I told you that these people, that the radical nutjob homosexual crowd was not going to be satisfied with court orders ordering states to issue marriage licenses.  Remember, the ultimate goal of this is not the happiness of homosexuals.  There may be a few that have bought into their own propaganda.  That is not the goal of this.  This agenda is driven to eliminate Christianity.  It must, it has to get rid of it.  Why do you think I am spending so much time on this, to try to beat this into people’s heads?  This is not about politics.  They want your soul.  They want your faith.  They have to attack the churches, they have to.  It is only when the churches are totally subservient to the will of the State that the final phase of Beelzebub’s plans can be implemented.  If you think it’s bad now, my brothers and sisters in Christ, you wait and see what these clowns have in store for us.  Mayor Parker is just the latest foot soldier in Beelzebub’s army.  We ought to get Father Ripperger on the line and see if we can perform an exorcism over the phone over this woman.  [mocking] “Come on, Mike, you’re really getting silly now.”

This is what is at stake here.  There is an epic battle going on.  We can’t see it.  It’s going on.  The forces of goodness, truth, and light, God and his angels, the saints, apostles, and the martyrs, standing battle against the hordes of demons that were cast out and walk and roam the earth in search of the ruin of souls.  That’s what’s going on here.  We’re in the middle.  We’re just humans.  We could go either way at some point in our soul’s existence.  Right now we’re in the human realm.  On deity, one God loves the humans, the one that created us in his image.  He loves us.  He created us as vessels of love.  The other guy, he didn’t like that.  He didn’t like that idea, which is why he revolted.  He has been eternally committed to undoing this and trying to sow and reap human misery.  See: Garden of Eden and original sin as first conquest.

What’s going on in Houston is going to happen, I bet you, in almost every state in the next couple of years if not sooner.  It’ll happen in large cities where there are libs that run the show.  They are not going to allow the clergy to stand in the way of the implementation of their agenda, which cannot have any theocratic presence whatsoever.  It doesn’t matter what it is, it has to eliminate it.  By eliminating it, it becomes the theocratic presence.  Those of you that are sitting out there in your little enclaves bemoaning, [mocking] “So you want me to live in a theocracy?”  As Chris Ferrara said the other day: You already do, sir, you already do.  The State’s religion today is its own authority.  It gets to make its religion up as it goes, you might have noticed as well.  You are not free to tell it no either, are you?  Now it’s found its way into the town made by Sam Houston.  Back to the story:

Rev. Dave Welch, executive director of the Texas Pastor Council, also received a subpoena. He said he will not be intimidated by the mayor.

“We’re not afraid of this bully,” he said. “We’re not intimidated at all.”

He accused the city of violating the law with the subpoenas and vowed to stand firm in the faith.

“We are not going to yield our First Amendment rights,” Welch told me. “This is absolutely a complete abuse of authority.”

Mike:  Again, I’m going to caution you people in Texas.  The First Amendment is not your protector.  This is not a First Amendment issue.  The Congress is not harassing or subpoenaing you.  The Department of Injustice is not harassing or subpoenaing you, yet.  Holder is gone, so they don’t have anybody that could do it or would want to do it, but give Obama time.  He’ll put somebody in there.  You are being harassed by the City of Houston.  The City of Houston answers to Austin, Texas and answers to the Texas Constitution.  We’ll get into that in just a moment.

There would be written into the subsidiarity or the law, the order of the government, not only of Texas but of the United States, that this is a matter of the clergy.  This is a matter of faith.  Madam, you will relent.  If you won’t, you will be impeached.  You are in violation of the law.

Tony Perkins, the head of the Family Research Council, said pastors around the nation should rally around the Houston ministers.

“The state is breaching the wall of separation between church and state,” Perkins told me. “Pastors need to step forward and challenge this across the country. I’d like to see literally thousands of pastors after they read this story begin to challenge government authorities – to dare them to come into their churches and demand their sermons.”

Perkins called the actions by Houston’s mayor “obscene” and said they “should not be tolerated.”

“This is a shot across the bow of the church,” he said.

Mike:  Let’s just stop right here and reflect on what we have learned and what I’ve learned and what we’ve studied and having Chris Ferrara here as a guest on this show, author of Liberty, the God That Failed, available in the Founders Tradin’ Post signed by Chris.  It’s a great book, a must-read, I would say.  Imagine for a moment that someone attempts to make this happen and the National Reform Alliance had succeeded in 1874 in inserting the God Clause into the preamble of the U.S. Constitution.  This would have caused the states, they would have amended their own constitutions.  They would have inserted similar clauses in here, meaning that radical homosexuality, the issue of homosexual marriage, the gender issues and other issues that the mayor is allegedly trying to, [mocking] “She’s just an advocate for the people.”  Yes, 1.6 percent of the population must triumph over the other 98.4 percent.

Imagine had that happened.  There would be written into the subsidiarity or the law, the order of the government, not only of Texas but of the United States, that this is a matter of the clergy.  This is a matter of faith.  Madam, you will relent.  If you won’t, you will be impeached.  You are in violation of the law.  We see right here, in all these instances, when I talk about the Godless, soulless Constitution and the mistake that it was, this is an example.  It is also an example of the same phenomena existing in all the states and their constitutions as well.  There is nothing inherent in the state constitutions that says there is a God or creator, and that law comes from the creator.  As a matter of fact, it says, in the Texas Constitution:

Sec. 1: Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States.

Mike:  In Texas’s constitution, it recognizes no authority other than the U.S. Constitution.  The U.S. Constitution recognizes no authority other than we the people.  If we the people demand homosexuality and homosexual unions, guess what, clergy?  There is no religious liberty.  We can scream and holler separation of church and state all you want.  Ultimately, if they want to force it down your throat, they will.  Let’s read a little further into the Texas State Constitution.

Sec. 2: All political power is inherent in the people, and all free governments are founded on their authority, and instituted for their benefit.

Mike:  No, all political power may be inherent in the people that execute the law, but it is founded on the authority of Almighty God.  He institutes these governments for their benefit.  Let’s read a little further.  What law is at issue here in Houston?

Sec. 8. Freedom of Speech and Press; Libel. Every person shall be at liberty to speak, write or publish his opinions on any subject, being responsible for the abuse of that privilege; and no law shall ever be passed curtailing the liberty of speech or of the press. [Mike: Here’s where it gets a little sketchy.] In prosecutions for the publication of papers, investigating the conduct of officers, or men in public capacity, or when the matter published is proper for public information, the truth thereof may be given in evidence.

Mike:  What does that mean?  That means that you don’t have the freedom of speech and the press clause when you are an officer of the State of Texas, or of any of its subsidiaries, Houston being one.  That’s what that means.  That means that if a case is brought against you, they can’t subpoena your work.  This applies to “investigating the conduct of officers, or men in public capacity.”  Some might argue, [mocking] “These pastors are in public capacity.”  They’re not in public capacity unless you define public as being inside the closed doors of a private assembly.  That’s not a public capacity.  If that’s a public capacity, then me doing the same thing, or Dwayne Stovall, our friend, former Senate candidate, doing it inside his house, then he’s in a public capacity if there are five people in his house.  This obviously only applies to the men employed by the state.  Two strikes and almost out is the mayor.  Is there another clause that applies?  There is:

Sec. 6. Freedom of Worship. All men have a natural and indefeasible right to worship Almighty God according to the dictates of their own consciences. No man shall be compelled to attend, erect or support any place of worship, or to maintain any ministry against his consent.

Mike:  If we can convince people that the government of the State of Texas, Mordor on the Potomac, all the governments are religious institutions now, because they are, you cannot be required to worship it.  I cannot be required to pay tithes to it either then, taxes.  There’s a defense I’d like for someone to take up.  Continuing:

No human authority ought, in any case whatever, to control or interfere with the rights of conscience in matters of religion, and no preference shall ever be given by law to any religious society or mode of worship. But it shall be the duty of the Legislature to pass such laws as may be necessary to protect equally every religious denomination in the peaceable enjoyment of its own mode of public worship.

Mike:  Unless the legislature has passed some law that I am not aware of, anointing homosexual radicals as a religious group or according them some sort of religious protection, then Clause 6 says the pastors can say what they want in pursuit of their faith from their podium, from their pulpit.  This is three strikes and you’re out using the Texas Constitution, which is why I keep telling you people: Drop the incorporation doctrine.  You’re never going to think in the manner proper to federalists or republicans if you keep throwing up the first and second amendments every time you think they apply.  They don’t.  Congress, the federal government is not persecuting these people.  The First Amendment to the U.S. Constitution would then apply if they were.  I would be the first one jumping on the bandwagon, getting on a trampoline and jumping up and down screaming and hollering and setting my hair on fire if they were.  If Eric Holder were doing it, same deal.  Eric Holder is not doing it; the mayor of Houston is.  Texas law prevails.  Why some of your people insist, [mocking] “Nah, Mike, it’s gotta be the Constitution.  Come on, man, it’s the First Amendment.”  No, it’s not the First Amendment.  You’ve been lied to your entire adult life, sir.  You need to purge this thought from your head.  It’s not legal, it’s ahistorical, and it’s not supported by the facts prior to 1920 or so.
