    If my right of self-defense (therefore the right to keep and bear arms) is an unalienable right the I cannot give that right away to any man, any government wether it be local, state or federal.

    I don’t have to believe in incorporation to get to the above. Does incorporation mean that the states cannot infringe speech, religion, arms, unreasonable searches, etc? I would argue these are all natural rights that no form of government can take away (except through lawful due process if I have used/abused my rights to cause harm to another). How does incorporation mean the feds take back control?

    I would like to propose that these natural rights which were self evident are those that are retained by the people (10th amendment).

    Mike Church is the greatest talk radio host ever! Even if I either disagree with Mr. Church on this issue or I am misreading him.

    Mr. Church,

    It appears to me that Mr. Napolitano is supporting incorporation.

    “The Constitution expressly prohibits all governments from infringing upon the right of the people to keep and bear arms. ”

    Isn’t the states or the people’s right to regulate firearms?

      He is coming around. Like most Libertarians, they do not care about process only about absolutes like “self defense” and since everyone is entitled to practice this then the national law should protect it. But we don’t have a national legislature, at least not in theory, so the Constitution, sans acting against the feds, is silent on the matter, leaving it to the People (and the States by proxy). If you substitue “chicken farming” for “self defense” you will see the contradiction and betrayal of self government, which as Henry & Mason said, was the greatest of all liberties.
