Mandeville LA – If you repeat a lie often enough it is said to become the truth and so it is with the commendable
yet ill-fated Louisiana law called the “Balanced Treatment For Creation Science and Evolution Science Act.” Some of you will remember that back in the 1980’s the State Legislature established this act over the hysterical cries of the the Times Picayune’s editors, aided and abetted by the hedonists at the ACLU1. As soon as the act passed the legal attacks began through the Treen then Edwards administrations. The plaintiffs headed straight to federal court for a pair of rulings basically declaring that the U.S. Constitution’s 1st Amendment prohibited anyone on Earth from teaching religion in public. However, Attorney General Billy Guste would not surrender and got the case in front of the proper jurists, the Louisiana Supreme Court. In 1983, that Court upheld the legislature’s right to pass the act and said nothing of it’s religiosity running afoul of this state’s constitution. Heresy, shouted the Editors and ACLU Santeriasts! To the US Supreme Court, we go!
On 19 June, 1987 the SCOTUS struck the law down because it violated the “establishment clause” which it clearly had not because Congress didn’t enact it therefore the SCOTUS had no say so in this state’s religious matters of state.
Fast forward to yesterday and the same editorialists are now howling over the Louisiana Senate’s failure to hermetically cleanse the state’s books by purging the Balanced Treatment Act. In covering that story, every media outlet I viewed, save the Picayune, repeated the lie that the Louisiana Supreme Court (it was the SCOTUS) had struck the law down in 1987 and therefore it is “unenforceable.” What is unenforceable is Louisiana’s Constitution which does not contain the word religion in Article VIII covering Education. I Article I Section VIII we learn there is a prohibition against the state “respecting an establishment of religion”.
I hardly think a non-denominational course, teaching the heaven sent origins of Man establishes a church, so what’s the big deal? The big deal is we can’t have children running around thinking they were created by any force other than the permission of Planned Parenthood.
