Caller Jim:  . . . should be convicted of a crime.

Mike:  Now you get into the legalese here where attorneys that are listening right now are going, [mocking] “Yeah, but the Supreme Court issued that ruling so now all the states are going to have to adjust all their laws and they’re all going to have to comply.”

Caller Jim:  But you and I both know that that’s hogwash.  The Supremacy Clause — you went over the whole history the first hour, and then you and Kevin talked about it even more extensively.  That’s the problem.  We’re living extra-constitutionally rather than living constitutionally.  Until we straighten out this extra-constitutional hogwash that we’re living under — and how we’re going to do that I have no clue — we’re going to be stuck with this.

Mike:  At least you’re honest.

Caller Jim:  I firmly believe and have believed for a long time that the Constitution is dead.  They stuck the stake through the heart . . .

Mike:  As you have identified the problem or the issue at hand, there is a solution that could be in hand as well.  I kind of alluded to it when I was talking to Kevin, although I didn’t get into any great detail.  The solution is, if the Constitution is dead — and I think the Constitution is dead.  It is a dead letter.  It no longer supervises a federal compact.  It no longer even pretends as though that there is a compact.  The people that live in the states and those that operate under the Constitution in the states as legislators are almost all derelict in their duty.  They don’t treat it as a federal compact any longer.  Some of them give lip service to it and they say they do but they don’t actually do it.  That’s the problem.

The issue that you’ve stumbled onto — now, remember, as philosophers — not many of you want to be philosophers.  That’s fine.  I’ll fill in for you because I love doing it.  As a philosopher, I must look for the ultimate cause.  If I’m not looking for Truth and I’m not looking for the ultimate cause, then I have no hope whatever of providing any relief to anyone listening to this show or writing me about it or reading my writings about it.  I can only offer antagonistic commentary that perpetuates or exacerbates the current dilemma.  If I think philosophically about it, I can actually philosophically diagnose the problem and propose a solution.

As a philosopher, how do I diagnose the problem?  What’s the error?  What is it that’s gone wrong?  What is it that’s gone wrong is that there is no longer an authority to turn to, a singular, direct authority that is recognized as an authority.  That’s the problem.  Was there an authority back in the day?  Once upon a time there was an authority.  I must tell you, ladies and gentlemen, that ‘Murica was founded by a bunch of people who had fled the authority from the continent.

It really is quite an amazing and depressing, I’ve got to say, thing to consider or to come to the realization of or to understand and know because it’s the truth, that those early settlers of the northeastern part of the United States were fleeing authority.  Mike, what authority were they fleeing, the king?  No, they weren’t fleeing the king’s authority.  They were fleeing the pope’s authority and anyone that remained acknowledging papal authority.  This is what Jordan Bloom writes about when he writes at Mitrailleuse about: Exactly when did Catholic Americans become comfortable with the idea that America has never been friendly to them, and still remains hostile?

As a philosopher, I say: Who do I ultimately obey?  Supernatural law.  Supernatural law gives us natural law.  Natural law thus says man/woman.  Supernatural law is attended by and overseen by the supernatural law, supernatural lawgiver.  So I obey the natural law.  The natural law is not in question.  We know what it is.  We can repeat it.  It has been the natural law since there has been man.
