Jonathan Vilma-Federalist?

When Who Dats ask me why I persist in promoting and explaining Louisiana as a sovereign state and the “federalism” that comes along with our voluntary membership in the union, I will now answer: Johnathan Vilma. Vilma, the beleagured New Orleans Saints player is suing NFL commish Roger Goodell for defaming his character without providing proof of the slur. Goodell’s response is that Vilma cannot sue the NFL for such a thing because a federal law and a federal court says so. Mr Goodell should pick up a copy of this [Mike holds up a Constitution] and read Amendment 11.

“The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State or by Citizens or Subjects of any Foreign State.” This was to clarify the Constitution’s Article III power that federal courts would only hear cases arising under the Constitution or the Laws of the United States. Vilma is not suing the United States. Vilma is not claiming a breach of Amendment 1 either. Vilma is suing Roger Goodell for ruining his character by stating Vilma’s guilt in a matter that Goodell refuses to provide evidence for.

The proper place to hear this case is in Louisana if that’s where the slander occurred and Vilma claims residence. Goodell’s attorney claims that under something called the federal “Labor Management Relations Act” that  Vilma somehow surrendered his rights under the LOUISIANA Constitution, Article I, section 7 which reads “ No law shall curtail or restrain the freedom of speech or of the press. Every person may speak, write, and publish his sentiments on any subject, but is responsible for abuse of that freedom.”

Goodell has abused that Freedom and Vilma is entitled to a hearing in a Louisiana Court to recoup losses that a judge or jury may award. That makes him a good Federalist in addition to one of the best linebackers in football.

Even Football Facts Are Stubborn Things

In a packed Boston courtroom the young lawyer paced back and forth several times before stopping in front of the jury box. Extending both of his arms, palms facing up, he told the eager jury “Facts… facts are stubborn things1.” The jury deliberated and then returned with 6 not guilty and two guilty verdicts for his clients2.   The case made the young lawyer one of the most famous men in the country and helped him launch a career in Congress.  That young mans name was John Adams and his clients were the British officers of the Boston Massacre.

NFL Commissioner Roger Goodell could learn some things from John Adams and return Linebacker Johnathan Vilma to active duty. The facts I speak of today come from the American Enterprise Institute’s Kevin Hassett and Stan Veuger who studied league injury reports during the time “BountyGate” was alleged to have happened. The men looked to see whether teams reported more injuries than normal the day after playing the Saints and the verdict is unequivocal.

“The data-driven answer is a resounding “no.” The Saints appear to have injured far fewer players… on average, 3.2 opposing players each game. [While] [t]he rest of the teams in the league caused, on average, 3.8 injuries per game3.” But wait WhoDats, that’s not all, remember that Johnathan Vilma, my favorite Federalist these days, is suing Goodell to put up or shut up and present facts to support his 1 year suspension. Here, Hasset and Veuger add “This difference is highly statistically significant, or in other words, it would hold up in a court of law…”

John Adams isn’t around to defend Vilma but his closing argument that sprang the Red Coats applies  “…whatever may be our wishes,… or the dictates of our passions, they cannot alter the state of facts and evidence” and the evidence says that Johnathan Vilma will be in a Saints uniform come opening day delivering the facts of NFL life to RG III.
