Mike: We’re going to get a full dose of at least ten if not twelve, maybe even thirteen candidates on the Republican side. I’ll just say, as a final question for Professor Kevin Gutzman here, author of James Madison and the Making of America, and working on a book on Thomas Jefferson right now – I’ve been asked this question in the last two months: Mike, do you think that Senator Cruz is eligible to be president? Mike, do you think Senator Rubio is eligible to be president? I say: What I think is immaterial here, because the question was never resolved about President Obama’s citizenship – we were told to just shut up and go with the storyline as it was written. I really don’t think, outside of ten people, that anyone really thinks whether or not either of those gentlemen are eligible to be president, do you?
Kevin Gutzman: Do I think anyone cares?
Mike: Is anyone really concerned about this any longer? Does it even matter?
Gutzman: I don’t think that anyone is. I actually, myself, think that the only way you could say Rubio was qualified is if you buy the anchor baby argument about the 14th Amendment. He’s an anchor baby. Under the original understanding, the child of two aliens temporarily in the United States would not be considered a natural-born citizen. Unless you buy the anchor baby argument, then you don’t think Rubio is qualified for president. That means if you vote for Rubio, you’re voting to grant citizenship to [private |FP-Monthly|FP-Yearly|FP-Yearly-WLK|FP-Yearly-So76|FP-Founding Brother|FP-Founding Father|FP-Lifetime]every illegal alien who’s ever been born here, which I think is unwise and unconstitutional.
Mike: Yes, but the miracle amendment says otherwise, or people read into the miracle amendment. As I’ve tried to explain over and over and over again, you have to put the miracle amendment in the context of the times in which it was conceived, ill-conceived, and then allegedly ratified, because it wasn’t, not under the mythology version of it that all the Southern states ratified it as a condition for admission into the union, which is perverted from the start. What they were trying to do with the miracle amendment was say: We’re going to have newly-freed slaves who have been heretofore considered three-fifths of a citizen, or whatever the counting was if they still did that for census purposes and for the choosing of representatives in the House. Now you have to say that if they were born on your plantation in North Carolina, then they have access to the laws of North Carolina. That’s what the birthright citizenship was designed to do, correct?
Gutzman: Yes. And actually, in the congressional discussion of the meaning of the citizenship clause of Section 1 of the 14th Amendment, the chief author of the 14th Amendment say, “Of course this doesn’t apply to aliens.” In other words, he could just have easily said: Of course this doesn’t apply to Rubio. Rubio’s parents were aliens when he was born here. The 14th Amendment citizenship clause does not apply to him. He should have had to get at the back of the line and wait his turn as a legal immigrant. This may be one reason why he favors grandfathering all the illegal aliens.[/private]
Mike: Sure, make himself legal.
Gutzman: I don’t think there’s any dispute now over his citizenship, but my point is there should have been. It was granted under a spurious reading of Section 1 of the 14th Amendment that was contrary even to the express explanation of the chief author of Section 1. I don’t think Rubio is qualified. I do think that Cruz is qualified. I’m not supporting either one of them, although it would not hurt my feelings if Cruz were elected. I don’t think he will be. As you said at the beginning, I think that likely this is going to be ignored completely.
